Terms of service

1. Purpose

These terms of service (ToS) govern access to and use of the usendit.io service (the “Service”), published by USENDIT — Alain Finckenbein. By accessing the Service, you acknowledge having read, understood and accepted these terms without reservation.

2. Service description

USENDIT.IO allows users to transfer digital files via a time-limited download link. The Service is offered in a free tier and paid tiers (“Pro” and “Pay-per-use”).

3. Service access

The Service is available 24/7, except in cases of force majeure or maintenance. The free tier requires no signup. Paid tiers require account creation.

4. User obligations

The user agrees to use the Service in compliance with applicable laws, not to transfer illegal content (counterfeit, child sexual abuse material, hate speech, malware, etc.), to hold the rights to the files transferred, not to spam or harass third parties, and not to attempt to bypass the Service’s technical limits.

5. Pricing and payment

The free tier is available without payment. Paid tiers are billed at the rates posted on the Pricing page. Payments are processed by our provider Revolut — no banking data is stored by USENDIT. Pursuant to Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to fully executed services (pay-per-use transfers once the link is generated).

6. Limitation of liability

USENDIT shall not be liable for indirect damages, data loss, loss of business or commercial harm resulting from the use of, or inability to use, the Service. Users are responsible for keeping a backup of their files — the Service is not a substitute for a backup solution.

7. Intellectual property

Users retain all rights to the files they transfer. USENDIT acquires no rights to such content, save those strictly necessary to provide the Service.

8. Suspension & termination

USENDIT reserves the right to suspend or delete an account in case of breach of these terms. Users may terminate their account at any time from their space or by e-mail.

9. Changes to the terms

USENDIT reserves the right to modify these terms at any time. Continued use of the Service constitutes acceptance of the modified terms.

10. Applicable law

These terms are governed by French law. In case of dispute, French courts have sole jurisdiction. Mandatory consumer-protection rules of the user’s country of residence remain unaffected. Pursuant to Article L.612-1 of the French Consumer Code, consumers may resort free of charge to a consumer ombudsman.
